Section 1. General Provisions

  1. These terms of service (hereinafter: the "Terms") set out the rules and conditions for using the "uHint.me" service (hereinafter: the "Service" or "uHint.me") and the services provided by the Provider.
  2. uHint.me consists of the uHint.me desktop application for macOS and Windows (hereinafter: the "App"), the account pages available at app.uhint.me, and the answer view available at live.uhint.me (together hereinafter: the "Application"). The Application listens to the live audio of a conversation from the audio source selected by the User, detects questions as they are asked, and shows short AI-generated answer cues in the answer view. The Application is intended for Consumers. Entrepreneurs may also use the Application on these Terms; provisions addressed to Consumers apply to Consumers and to Entrepreneurs with Consumer rights.
  3. These Terms constitute the terms of service referred to in Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services (hereinafter: the "Electronic Services Act").
  4. The service provider is Daniel Loposzko, operating under the business name Zinit Daniel Loposzko (registered office: ul. Sportowa 35, 55-040 Kobierzyce, Poland), registered in the Central Register of Business Activity (CEIDG) maintained by the minister responsible for the economy, Tax Identification Number (NIP): 896-116-23-34, Statistical Identification Number (REGON): 021006839 (hereinafter: the "Provider").
  5. The Provider may be contacted:
    1. by email: info@uhint.me,
    2. through the contact form at app.uhint.me/contact,
    3. by mail: ul. Sportowa 35, 55-040 Kobierzyce, Poland,
    4. by phone: +48 734 608 442.
  6. In accordance with Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC (the Digital Services Act, hereinafter: "DSA"), the Provider has designated a point of contact for direct communication with Member State authorities, the European Commission, the European Board for Digital Services, and Users on matters covered by the DSA. The point of contact is available at: info@uhint.me. Communication may be conducted in Polish or English.
  7. Before using the Application, the User is required to read the Terms and the Privacy Policy. Registration requires accepting the Terms.

Section 2. Definitions

Capitalized terms used in these Terms have the following meanings:

Section 3. Technical Requirements, Usage Rules and Security

  1. In order to properly use the Application, all of the following are required:
    1. an Internet connection on the computer running the App and on the device showing the Answer View,
    2. a computer running macOS 14.2 or later, or Windows 11 (64-bit), with the App installed from the download page at app.uhint.me/download,
    3. a current web browser (on the same computer, a phone or any other device) for the account pages and the Answer View; no app is needed on the phone,
    4. an active email account to which one-time sign-in codes can be delivered,
    5. for the Computer audio source: the ability of the operating system to capture the audio played by the computer; for the Microphone source: a working microphone and the operating system permission to use it.
  2. The App captures audio only from the one source selected for a Session: Microphone or Computer audio. Computer audio does not include the microphone. The App does not record or save audio on the User's computer.
  3. Users are prohibited from:
    1. using viruses, bots, worms or other computer code, files or programs within the Application, in particular scripts and tools automating Sessions, sign-in or registration,
    2. attempting to gain access to another User's Account, Session, Answer View or Session PIN, or to the Provider's systems,
    3. sharing one-time codes, the App credential or the Session PIN with third parties, or making the Answer View available to persons who are not parties to the User's conversation,
    4. feeding the Application with audio that the User is not permitted to process, or using the Application to the detriment of other participants of a conversation,
    5. reverse engineering, decompiling or disassembling the App except to the extent permitted by mandatory law,
    6. reselling or otherwise commercially making the Service available to third parties,
    7. using the Application during an examination, test, certification, assessment or other evaluation in which the use of aids, notes or outside help is prohibited by its rules,
    8. using the Application in a conversation to which the User is not a party, or which the User is not entitled to listen to,
    9. using the Application to obtain information from other participants covertly where the law applicable to the conversation requires their consent or notice,
    10. using the Application to evaluate, score, rank, select, monitor or make decisions about any person, in particular as an employer, recruiter, examiner or teacher assessing other participants of a conversation.
  4. The User is solely responsible for determining whether using the Application in a given conversation is permitted by the law applicable to the User and to the conversation (including laws on the recording and processing of conversations and on the processing of personal data), by the rules of the organiser of the conversation, and by agreements and obligations binding on the User (for example examination, certification or recruitment rules, employer policies, and confidentiality obligations). The Provider recommends informing the other participants that uHint.me processes the audio of the conversation in real time. The Provider does not verify how the User uses the Application. The Provider may block or terminate an Account used for a purpose listed in subsection 3, items 7–10, in accordance with Section 4, subsection 17.
  5. The Provider uses cryptographic protection of electronic transfers and digital content through appropriate logical, organisational and technical measures, in particular to prevent third-party access to data, including TLS encryption of all connections between the App, the browser and the Provider's servers, one-time sign-in codes, and credentials stored in the operating system's protected storage (macOS Keychain or Windows Credential Manager).
  6. The Provider informs that, despite the security measures referred to in subsection 5, the use of the Internet and electronically provided services may be subject to the risk of malicious software entering the User's IT system and device, or of third parties gaining access to data on that device. To minimise this risk, the Provider recommends keeping the operating system and the App up to date, protecting access to the email account used for the Account, and using antivirus software.
  7. Anyone who can read the User's email can sign in to the User's Account. The User is required to secure access to that email account and, if the User suspects unauthorised access, to promptly use "Sign out all apps" on the account pages and contact the Provider, who can secure the Account.
  8. Use of the Application is free of charge within the free trial and within Session Time granted free of charge. Session Time beyond that is subject to a fee on the terms set out in Sections 5 and 6 of these Terms.
  9. Users are required to provide only data that is accurate and true. The Provider is not liable for the consequences of the User providing false or incomplete data.
  10. One natural person may hold one Account. The free trial is granted once per email address, also where an Account with that email address was previously deleted.

Section 4. Service Agreement

  1. Under the Agreement, the Provider enables the User to use the Application's features within the limits of the User's Session Time balance.
  2. The Application is intended for adults. It may be used only by persons who have reached the age of 18 (eighteen) and have full legal capacity. The Application is not directed to children. The Provider does not knowingly collect personal data from persons under 18 and, with respect to the United States, from children under 13 (thirteen) within the meaning of the Children's Online Privacy Protection Act (COPPA). By ticking the box referred to in subsection 3, item 4, the User declares that they are at least 18 years old. If the Provider learns that an Account is held by a person under 18, the Provider deletes the Account with the effects described in subsection 18.
  3. To conclude the Agreement, the User should perform the following actions:
    1. enter their email address in the App (Sign in screen) or on the sign-in page at app.uhint.me/sign-in,
    2. open the registration page to which the Application directs an email address without an Account,
    3. choose the conversation language,
    4. read the Terms and the Privacy Policy and tick the required box "I am at least 18 years old, I accept the Terms of Service and I have read the Privacy Notice",
    5. click "Register".
  4. Clicking "Register" with the box ticked is equivalent to the conclusion of a free Agreement. The Account is created at that moment. The email address is confirmed at the first successful sign-in with a one-time code; the free trial referred to in subsection 7 is credited at that moment.
  5. Signing in: the User enters the Account email address in the App or on the sign-in page and requests a one-time code. The Provider sends an 8-digit code to the Account email address. The code is valid for 15 minutes, works once and allows 5 attempts. The number of codes per email address and per network address is limited to protect the Account.
  6. The Provider issues to each signed-in installation of the App a credential stored in the operating system's protected storage. The User may sign out the current App, and may sign out all apps signed in to the Account from the account pages ("Sign out all apps"). A browser signed in to the account pages stays signed in until it signs out or its session expires (30 days).
  7. The User is granted a free trial, credited at the first successful sign-in (subsection 4): the amount of Session Time shown on the registration form (at the date of these Terms: 60 minutes, i.e. "your first hour free"), once per email address.
  8. To run a Session, the User:
    1. opens the App and signs in,
    2. chooses one audio source: Microphone or Computer audio,
    3. presses Start; the App shows the Answer View address and the Session PIN,
    4. opens the Answer View on any device and enters the Session PIN,
    5. presses Stop when the conversation ends.
  9. A Session requires a positive Session Time balance at Start. A Session ends when the User presses Stop, when the Session Time balance is exhausted, or when the connection is permanently lost. Session Time is counted from Start to Stop and deducted from the balance when the Session is settled. One Account may run one Session at a time.
  10. The Answer View of a Session is available while the Session is running and for a short time after it ends (currently up to 10 minutes), after which the Answer Cues are discarded by the Provider and cannot be retrieved. The Provider does not store the audio, transcripts, detected questions or Answer Cues of a Session. The User who wishes to keep an Answer Cue must note it down during that time.
  11. The Provider operates the Service with a limited capacity of concurrent Sessions. If the capacity is reached, the App informs the User that the Session cannot start at that moment and the User may try again later; no Session Time is deducted for a Session that did not start.
  12. The Provider informs and the User acknowledges that maintaining the conformity of the Service with the Agreement requires installing updates of the App made available by the Provider on the download page. The Provider may require a minimum version of the App; an outdated App is informed that it must be updated before a Session can start.
  13. If the User is not granted access to the Service promptly after the conclusion of the Agreement, the User shall request the Provider to grant access without delay. The request may be sent by email to the address specified in Section 1, subsection 5, item 1. If the Provider fails to grant access promptly upon receipt of the request, the User may withdraw from the Agreement.
  14. Regardless of subsection 13, if the User is not granted access to the Service, the User may withdraw from the Agreement without requesting the Provider to grant access, where at least one of the circumstances specified in Article 43j(5) of the Consumer Rights Act applies.
  15. The User may terminate the Agreement at any time by deleting their Account on the account pages (Account → Delete account) or by requesting deletion of the Account by email to the address specified in Section 1, subsection 5, item 1.
  16. Withdrawal by the User from the Agreement or its termination, regardless of the basis, is effected by submitting a declaration of withdrawal or termination to the Provider, or by deleting the Account as described in subsection 15. A declaration may be sent by email to the address specified in Section 1, subsection 5, item 1.
  17. In the event of a breach of the Terms by the User that is not remedied despite a request to do so, the Provider may terminate the Agreement with a notice period of 7 (seven) days by submitting a declaration of termination by email. Upon expiry of the notice period, the Provider discontinues the Service. During the notice period the Provider may block the User's access to the Service if necessary to prevent further breaches. The Provider may block access to the Account without notice where this is necessary to stop an ongoing serious breach (in particular an attack on the Provider's systems or on other Users' Accounts) or where required by law; the User is then informed by email.
  18. Deletion of the Account has the following effects, of which the User is informed before confirming deletion:
    1. the email address is removed from the Account and all devices and browsers signed in to the Account are signed out,
    2. the remaining Session Time balance is lost; the price paid for unused purchased Session Time is refunded where the Agreement ends by withdrawal (Sections 7 and 8), by termination because of an adverse change to the Service (Section 15, subsection 4) or by discontinuation of the Service by the Provider (Section 15, subsection 8); Session Time granted free of charge is never refunded,
    3. a Session in progress and its Answer View continue until Stop; no new Session can start,
    4. the Session history (dates and durations, without the email address) and the Session Time ledger are retained for the period described in the Privacy Policy,
    5. registering again with the same email address does not grant another free trial.
  19. The User has the right to receive a copy of the data concerning the User held by the Provider (the Account data, the Session history and the Session Time ledger) in a structured, machine-readable format (JSON) within the time limits set out in the Privacy Policy, Section 8, subsection 3 (one month of receipt, extendable in justified cases), after a request sent to the address specified in Section 1, subsection 5, item 1. Because the Provider does not store Session content, no transcripts or Answer Cues can be provided.
  20. The User may request a change of the Account email address by writing to the Provider (Section 1, subsection 5, item 1) from the current Account email address. Before making the change, the Provider verifies that the User controls the new address. The new address may not belong to another Account, and the free trial is not granted again on a change of address.

Section 5. Fees and Billing

  1. The Service is paid for with Session Time. The price of Session Time is set out in the Price List. At the date of these Terms the Price List is: first hour free (the free trial on registration), then USD 2 (two US dollars) per hour of Session Time. There is no subscription and no recurring charge.
  2. Launch offer: until 31 December 2026 the Service is free of charge. A User who needs more Session Time than the free trial contacts the Provider (Section 1, subsection 5) and states how many hours they need; the Provider adds the Session Time to the Account at no charge. The Provider may reasonably limit the amount granted per User and per request. Session Time granted free of charge has no monetary value and is not refunded or exchanged for money.
  3. During the launch offer no payment is processed in the Application; the Top up page states that payments are coming soon. Paid top-ups of Session Time will become available on a date announced in the Application and on the uhint.me website. Before the first paid top-up is offered, the Provider will set out in these Terms, in the procedure of Section 16, the rules of payment: payment methods, the payment service provider, currencies and conversion, taxes, billing documents and the request referred to in Section 8, subsection 5. Until then the price in subsection 1 and the Price List are for information only, nothing in Sections 5 and 6 obliges the User to pay anything, and the price may change before paid top-ups launch.
  4. Prices in the Price List are expressed in US dollars. Prices shown to Consumers are total prices and include all taxes (including VAT where it applies in the Consumer's country). Where a price depends on the Consumer's country or is offered in another currency, the final price is shown before the purchase is confirmed.
  5. Session Time is deducted from the balance in whole seconds of a Session, counted from Start to Stop. Sessions that are not settled yet (for example a Session interrupted by a lost connection) are not deducted until they are settled. The current balance, the Session history and all additions and corrections of Session Time are shown on the account pages. When Session Time is added to the Account (a purchase or a grant), the Provider sends a confirmation to the Account email address stating the amount added and the current balance.
  6. If the Provider makes an error in the Session Time balance, it corrects it with a new entry in the Session Time ledger; the User may raise an objection in a complaint under Section 7.
  7. Session Time purchased or granted does not expire while the Account exists, subject to Section 15, subsection 8. An expiry may be introduced only by a change to these Terms under Section 16 and will not apply to Session Time credited before the change takes effect.
  8. Changes to prices in the Price List are announced in the Application and on the uhint.me website and do not constitute changes to these Terms. Changes do not affect Session Time already credited to an Account.

Section 6. Price List

  1. The current Price List is available on the uhint.me website (Pricing) and in the Application (Top up page).
  2. The Price List may provide for Session Time granted free of charge, in particular the free trial on registration and the launch offer described in Section 5, subsection 2.
  3. The Provider may change the Price List at any time.
  4. Changes to the Price List shall in no way affect the price of Session Time purchased before the change or the Session Time balance already credited to an Account.

Section 7. Complaints

  1. The Service provided to the User by the Provider must conform with the Agreement for the entire duration of the Service.
  2. The Provider is liable for any Non-Conformity discovered during the period of the Service.
  3. If a Non-Conformity is discovered, the User may submit a complaint requesting that the Service be brought into conformity with the Agreement.
  4. Complaints are submitted by email to the address specified in Section 1, subsection 5, item 1, or through the contact form at app.uhint.me/contact.
  5. A complaint should contain:
    1. the User's first and last name,
    2. the Account email address,
    3. a description of the Non-Conformity discovered, where possible with the date and approximate time of the Session concerned,
    4. a request to bring the Service into conformity with the Agreement.
  6. The Provider may refuse to bring the Service into conformity with the Agreement if it is impossible or would require the Provider to incur disproportionate costs.
  7. After considering the complaint, the Provider provides the User with a response in which it:
    1. accepts the complaint and indicates the planned date for bringing the Service into conformity with the Agreement,
    2. refuses to bring the Service into conformity with the Agreement for the reasons specified in subsection 6 above,
    3. rejects the complaint as unfounded.
  8. The Provider responds to the complaint by email within 14 (fourteen) days of receipt. For complaints submitted by Entrepreneurs who are not Entrepreneurs with Consumer rights, the response period is 30 (thirty) days.
  9. If the complaint is accepted, the Provider brings the Service into conformity with the Agreement at its own cost within a reasonable time from receipt of the complaint and without excessive inconvenience to the User, taking into account the nature of the Service and the purpose for which it is used. Where a Session was unusable because of a Non-Conformity, the Provider may bring the Service into conformity by crediting the Session Time of that Session back to the Account.
  10. If a Non-Conformity is discovered, the User may submit a declaration of price reduction or withdrawal from the Agreement to the Provider where:
    1. bringing the Service into conformity with the Agreement is impossible or requires disproportionate costs,
    2. the Provider has not brought the Service into conformity with the Agreement in accordance with subsection 9 above,
    3. the Non-Conformity persists despite the Provider's attempt to bring the Service into conformity,
    4. the Non-Conformity is sufficiently serious to justify withdrawal from the Agreement without first requesting the Provider to bring the Service into conformity,
    5. it is clear from the Provider's statement or from the circumstances that the Provider will not bring the Service into conformity within a reasonable time or without excessive inconvenience to the User.
  11. The declaration of price reduction or withdrawal may be submitted by email to the address specified in Section 1, subsection 5, item 1.
  12. The declaration should contain:
    1. the User's first and last name,
    2. the Account email address,
    3. the date on which the Service was provided (the Session concerned),
    4. a description of the Non-Conformity,
    5. an indication of the reason for the declaration, selected from the reasons specified in subsection 10 above,
    6. a declaration of price reduction together with the reduced price, or a declaration of withdrawal from the Agreement.
  13. The reduced price must be in such proportion to the price under the Agreement as the value of the non-conforming Service bears to the value of a conforming Service. The Provider refunds amounts due as a result of a price reduction promptly, no later than within 14 (fourteen) days of receipt of the declaration. For Session Time granted free of charge no refund is due, because no price was paid.
  14. In the event of the User's withdrawal from the Agreement, the Provider deletes the Account promptly upon receipt of the withdrawal declaration, and, where the withdrawal concerns paid Session Time, refunds the price paid for unused Session Time and the part of the price attributable to the Session Time used while the Service was not in conformity with the Agreement.
  15. Pursuant to Article 34(1a) of the Consumer Rights Act, in the event of the User's withdrawal from the Agreement, the User is obligated to cease using the Service and making it available to third parties.

Section 8. Right of Withdrawal

  1. Pursuant to Articles 27 et seq. of the Consumer Rights Act, a User who is a Consumer or an Entrepreneur with Consumer rights has the right to withdraw from the Agreement without giving any reason within 14 (fourteen) days of its conclusion. The same applies to each purchase of Session Time, counted from the day of the purchase.
  2. The User exercises the right of withdrawal by submitting a withdrawal declaration to the Provider. To meet the withdrawal deadline, it is sufficient to send the declaration before expiry of the period referred to in subsection 1.
  3. The withdrawal declaration may be submitted in any form, in particular by email to the address specified in Section 1, subsection 5, item 1. The User may use the model withdrawal form in Annex 1 to these Terms, but this is not mandatory.
  4. Upon receipt of the withdrawal declaration, the Provider promptly sends the User an acknowledgment of receipt by email.
  5. In the event of the User's withdrawal from the Agreement, the Provider deletes the Account promptly upon receipt of the withdrawal declaration. Purchased Session Time is made available before the end of the withdrawal period only at the Consumer's express request made at the purchase; the Provider confirms that request, together with the information that the Consumer will pay for the Session Time used before withdrawal, in the purchase confirmation sent by email. In the event of withdrawal from a purchase of Session Time, the Provider removes the purchased Session Time from the Account and refunds the price paid, less an amount proportional to the Session Time used before the withdrawal (Article 35 of the Consumer Rights Act). The free trial and Session Time granted free of charge have no monetary value and are not refunded.
  6. Refunds are made using the same payment method that the User used, unless the User expressly agreed otherwise, within 14 (fourteen) days of receipt of the withdrawal declaration.

Section 9. User Content and Reviews

  1. The Application does not offer the publication of content by Users: audio streamed during a Session, detected questions and Answer Cues are visible only to the User in their own Answer View and are not stored by the Provider. Section 9 therefore concerns Reviews and messages sent to the Provider.
  2. The User may send the Provider a review of the Service (hereinafter: a "Review"), in any manner, including by email or through the contact form.
  3. Sending a Review does not impose an obligation on the Provider to publish it. A Review published by the Provider (for example on the uhint.me website) may be removed by the Provider at any time.
  4. The following Reviews and messages are prohibited:
    1. containing false data, contrary to law, the Terms or good practice,
    2. containing content intended to promote activities prohibited by law, inciting violence or hatred, or insulting any group of persons or individual,
    3. containing content that may infringe personal rights, copyrights, image rights or other rights of third parties,
    4. containing advertising, promotional, political, religious or discriminatory content,
    5. containing content promoting activities competitive with the Provider.
  5. Any person may report to the Provider, by email to info@uhint.me, a Review published by the Provider that may violate the Terms or the law, or a use of the Application that they believe to be unlawful. A report should state where the content is (for example its address on the uhint.me website), why it is considered unlawful or contrary to the Terms, and how the Provider can contact the reporter.
  6. The Provider confirms receipt of a report, examines it within 14 days of receiving a report that contains the information listed in subsection 5, removes or corrects a published Review where justified, and informs the reporter and, where the author can be reached, the author of the Review of the outcome and the reasons. Decisions are made by a person, not by automated means.
  7. The author of a removed Review or a reporter whose report was denied may ask the Provider to reconsider the decision, by email to info@uhint.me, stating the reasons. The Provider responds within 14 days of receipt.
  8. Sending a Review is equivalent to the User's declaration that they are its sole author. The User bears full responsibility for the content of the Review and the consequences of its publication.
  9. Sending a Review does not grant the Provider any licence to it. The Provider publishes a Review (for example on the uhint.me website) only with the User's separate, express consent, given by email, to the exact text to be published and to the form of attribution (for example first name and role, initials, or no attribution). The User may withdraw that consent at any time by email to info@uhint.me; the Provider then removes the Review within 14 days.

Section 10. Use of Artificial Intelligence (AI)

  1. The Provider informs that the Application uses artificial intelligence technologies to provide the Service:
    1. question detection in live audio: real-time speech and language models,
    2. speech-to-text transcription of live audio: speech recognition models,
    3. deciding whether a detected question gets an Answer Cue, generating the Answer Cue, and deciding whether a new question continues the previous one: large language models,
    4. all of the above are provided by Microsoft Corporation through the Microsoft Azure AI services and processed in Microsoft data centres in the European Union. The Provider may replace a model with another model provided by Microsoft and processed in the European Union without changing these Terms; a change of the AI provider or of the place of processing is announced as described in the Privacy Policy,
    5. intended purpose and risk category under Regulation (EU) 2024/1689 of the European Parliament and of the Council (EU AI Act): the intended purpose of the Application is to assist the User, in real time, in a conversation in which the User takes part, by detecting questions addressed to the User and showing the User Answer Cues. The Application is not intended to, and must not be used to, evaluate, score, rank, select, monitor or make decisions about any person, including candidates, employees, students or other participants of a conversation (Section 3, subsection 3, item 10). Used for its intended purpose, the Application is not a high-risk AI system within the meaning of Article 6 and Annex III of the EU AI Act. These Terms inform the User that the Answer Cues are generated by AI. A User who uses the Application for another purpose does so outside its intended purpose and at their own risk.
  2. The User acknowledges that Answer Cues and the detection of questions:
    1. are generated automatically from the audio of the conversation and may contain errors, inaccuracies or so-called AI hallucinations (content not grounded in fact),
    2. may miss a question, detect a question that was not asked, or attach an Answer Cue to the wrong question,
    3. require the User's own verification and judgment before use,
    4. do not constitute legal, medical, financial or any other professional advice, and do not constitute answers about the User's own experience, projects or decisions.
  3. No guarantee of effectiveness. The entire process, from hearing the question to showing the Answer Cue, is performed by artificial intelligence, which is an imprecise tool. The Provider does not guarantee that every question will be detected, that a detected question will be understood correctly, that an Answer Cue will be shown for it, that the Answer Cue will be correct, complete or relevant to the User's field, or that it will arrive in time to be useful. The quality of detection and of Answer Cues depends, among other things, on the audio quality, the conversation language, the accent and speaking style of the participants, the subject matter, and the availability of the AI services. For this reason the Provider recommends that, before relying on the Application in an important conversation, the User runs a test Session on the Microphone source and asks the Application, aloud, the kinds of questions that matter in the User's field, in order to assess for themselves the quality of the help they can expect. The free trial is intended for such a test. The Provider is not liable for the consequences of a question not being detected or of an Answer Cue being missing, late, incorrect or incomplete, subject to the mandatory rights of Consumers under Section 7.
  4. The User undertakes to:
    1. use Answer Cues only as talking points for their own answer,
    2. not rely exclusively on Answer Cues when making decisions,
    3. comply with any transparency requirements that apply to the User when sharing AI-generated content with third parties,
    4. not use the Application in conversations whose subject is the health, religious or philosophical beliefs, political opinions, trade union membership, sexual life or orientation, ethnic origin or genetic data of other participants (for example medical, psychological, religious or legal counselling); the Application is not intended for such conversations. Incidental mentions of such matters in other conversations are processed in real time and discarded like all other Session content,
    5. where the law applicable to the conversation or the rules of the organiser require it, inform the other participants that the Application is used, or obtain their consent, before the Session. The Privacy Policy (Section 4, subsection 8) contains a short notice text that the User may use for this purpose.
  5. Data processed by the AI technologies:
    1. the audio of the selected source (which may contain the voices of the User and of the other participants of the conversation) is streamed from the App to the Provider's server and forwarded in real time to the Microsoft Azure AI services referred to in subsection 1 solely for question detection and transcription,
    2. the transcript of the relevant fragment and the detected question are forwarded to the large language models referred to in subsection 1, item 3, solely for generating the Answer Cue and the related decisions,
    3. the Provider does not store the audio, transcripts, detected questions or Answer Cues after the Session (subject to Section 4, subsection 10),
    4. Microsoft processes this data under Microsoft's data protection terms for Azure services and does not use it to train its models; Microsoft may temporarily retain prompts, audio and outputs for abuse monitoring in accordance with the terms of the Azure AI services, for a limited period which, according to Microsoft's documentation applicable on the date of these Terms, does not exceed 30 days. The Provider has not obtained an exemption from that monitoring and treats that retention by Microsoft as applicable. Details are in the Privacy Policy, Section 4,
    5. the Provider does not use Session content to train or improve models.
  6. To the extent permitted by applicable law, the Provider shall not be liable for:
    1. decisions made by the User on the basis of Answer Cues,
    2. damage arising from incorrect, incomplete or missing Answer Cues,
    3. the consequences of the User's use of the Application or of Answer Cues in a conversation, examination, recruitment process or other context in which such use is prohibited (Section 3, subsection 3, items 7–10) or undisclosed.
  7. Answer Cues belong to the User to the extent permitted by law. The User acknowledges that AI-generated content may not be eligible for copyright protection, and that similar content may be generated for other Users; the Provider does not guarantee the uniqueness of Answer Cues.

Section 11. Liability and Service Levels

  1. The Provider undertakes to provide the Service with due diligence.
  2. The Provider does not guarantee a specific level of availability of the Service, a specific number of detected questions, or a specific delay between a question and its Answer Cue. The Service depends on the User's Internet connection and on the availability of the AI services of the Provider's suppliers. Section 10, subsection 3 applies to the detection of questions and the quality of Answer Cues.
  3. To the extent permitted by the provisions of the Civil Code and the Consumer Rights Act, the Provider shall not be liable to the User for the consequences of:
    1. the User's use of the Application in a manner inconsistent with its intended purpose, the Terms or applicable law,
    2. the User providing incorrect or false data,
    3. the use of one-time codes, the App credential or the Session PIN by third parties, if such third parties obtained them as a result of disclosure by the User or as a result of inadequate protection by the User (including inadequate protection of the User's email account),
    4. the User's choice of the audio source, in particular a Session run on the Microphone source when the conversation was played by the computer (or the reverse).
  4. To the extent permitted by the provisions of the Civil Code and the Consumer Rights Act, the Provider shall not be liable for disruptions in the functioning of the Application arising from:
    1. force majeure, including an outage of the external services referred to in Section 10 for reasons beyond the Provider's control (this does not include the Provider's failure to pay for, configure or maintain those services) or a legal ban on the use of specific AI models,
    2. necessary maintenance work on the Application,
    3. causes attributable to the User, including the User's Internet connection, device, operating system permissions or audio setup,
    4. causes beyond the Provider's control, in particular actions of third parties for which the Provider is not liable.
  5. The Provider undertakes to carry out the maintenance work referred to in subsection 4, item 2 in a manner that is as minimally disruptive to Users as possible and, where feasible, to inform Users of planned work in advance on the account pages.
  6. The Provider undertakes to remedy disruptions in the functioning of the Application on an ongoing basis to the extent feasible. Session Time of a Session that could not be used because of a disruption attributable to the Provider is credited back to the Account on request under Section 7.
  7. The Provider's liability towards Users who are Entrepreneurs (other than Entrepreneurs with Consumer rights) is limited to the greater of the amount paid by the User for Session Time in the 12 (twelve) months preceding the event giving rise to the claim and USD 100 (one hundred US dollars), and excludes lost profits. This limitation does not apply to damage caused intentionally (Article 473 § 2 of the Civil Code).
  8. Additional provisions for Users from outside the European Economic Area (Disclaimer of Warranties): TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. The Provider does not warrant that the Service will operate uninterrupted, error-free or securely, or that Answer Cues will be accurate, complete or reliable. This subsection does not apply to Users who are Consumers within the meaning of European Union law or Polish law, to the extent that the exclusion of warranties would be contrary to mandatory consumer protection provisions.
  9. Limitation of Liability (Users from outside the European Economic Area): TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER'S TOTAL LIABILITY TO THE USER FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE (INCLUDING LIABILITY IN CONTRACT, TORT, NEGLIGENCE OR OTHERWISE) SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE USER TO THE PROVIDER IN THE 12 (TWELVE) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD 100 (OR THE EQUIVALENT IN LOCAL CURRENCY), WHICHEVER IS GREATER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, LOSS OF A JOB OPPORTUNITY OR BUSINESS INTERRUPTION, REGARDLESS OF THE LEGAL THEORY OF THE CLAIM. This subsection does not apply to Users who are Consumers within the meaning of European Union law or Polish law, to the extent that the limitation of liability would be contrary to mandatory consumer protection provisions.
  10. Indemnification: to the maximum extent permitted by applicable law, the User agrees to indemnify, defend and hold harmless the Provider, its employees, contractors and subcontractors from and against any and all claims, damages, costs and expenses (including reasonable legal fees) arising from:
    1. the User's breach of these Terms,
    2. the User's use of the Service in a manner inconsistent with its intended purpose or applicable law, including the processing of the audio of a conversation without the required permission or notice,
    3. the User's infringement of third-party rights in connection with the use of the Service. This subsection does not apply to Users who are Consumers within the meaning of European Union law or Polish law.
  11. Class Action Waiver: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTES BETWEEN THE USER AND THE PROVIDER SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. THE USER WAIVES THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CONSOLIDATED PROCEEDINGS OR REPRESENTATIVE ACTIONS AGAINST THE PROVIDER. This subsection applies exclusively to Users who are residents of the United States of America, to the extent permitted by applicable state and federal law.
  12. If any provision of subsections 8–11 is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law (severability).

Section 12. Provider's Intellectual Property

  1. All components of the Application, in particular:
    1. the name uHint.me and the uHint.me wordmark and logo,
    2. the App, its graphic elements, interface, software and source code,
    3. the account pages, the Answer View and the uhint.me website, their texts, graphics and layout,
    4. the operating principles of the Application, including the prompts and configuration of the AI stages, are protected under the provisions of the Polish Copyright and Related Rights Act of 4 February 1994, the Industrial Property Law Act of 30 June 2000, the Act on Combating Unfair Competition of 16 April 1993 and other generally applicable legal provisions, including European Union law.
  2. The Provider grants the User, for the duration of the Agreement, a non-exclusive, non-transferable licence to install and use the App on computers used by the User, solely for the purpose of using the Service in accordance with the Terms. The App may use third-party open-source components; their licences are listed in the App.
  3. Any use of the Provider's intellectual property without the Provider's prior, express consent, in violation of these Terms, is prohibited.

Section 13. Out-of-Court Dispute Resolution

  1. A User who is a Consumer or an Entrepreneur with Consumer rights has the option to use out-of-court complaint and claim resolution methods.
  2. Detailed information on the options for using out-of-court complaint and claim resolution methods, and the rules of access to these procedures, is available at the offices and on the websites of:
    1. county (municipal) consumer ombudsmen and social organisations whose statutory tasks include consumer protection,
    2. Voivodeship Inspectorates of the Trade Inspection,
    3. the Office of Competition and Consumer Protection (UOKiK), www.uokik.gov.pl.

Section 14. Personal Data

  1. Information on the processing of personal data by the Provider, including the processing of the audio of conversations and of the data of other participants, can be found in the Privacy Policy available at uhint.me/privacy.
  2. The audio of a conversation, its transcript, the detected questions and the Answer Cues (hereinafter: "Session Content") may contain personal data of the User and of the other participants of the conversation. The User alone decides whether, when and from which audio source a Session is run, and for what purpose. To the extent the User's use of the Application is not a purely personal activity and the User is a controller of the personal data of the other participants, the Provider processes Session Content on the User's behalf and on the User's documented instruction, which consists of running the Session, and the following terms apply (Article 28 GDPR):
    1. subject matter, nature and purpose: real-time processing of Session Content solely to detect questions and generate Answer Cues for the User; duration: the Agreement; categories of data subjects: the User and the other participants of the conversation; categories of data: voice, spoken content and any personal data it contains,
    2. the Provider processes Session Content only on the User's documented instructions, which consist of running a Session and of these Terms, including with regard to transfers to third countries; the Provider informs the User immediately if, in its opinion, an instruction infringes the GDPR or other data protection law,
    3. the persons authorised by the Provider to process Session Content are bound by confidentiality,
    4. the Provider applies the security measures described in the Privacy Policy, Section 10 (Article 32 GDPR),
    5. the Provider engages only the sub-processors listed in the Privacy Policy, Section 5, and imposes on them data protection obligations equivalent to those in this subsection. The Provider informs the User of an intended addition or replacement of a sub-processor at least 14 (fourteen) days before it takes effect, by email to the Account email address; the User may object by terminating the Agreement before that date,
    6. the Provider assists the User, by appropriate technical and organisational measures and to the extent possible given that no Session Content is stored, in responding to requests of data subjects (Articles 12–22 GDPR) and in meeting the User's obligations under Articles 32–36 GDPR, including by notifying the User without undue delay after becoming aware of a personal data breach concerning Session Content, and in a data protection impact assessment or prior consultation where the User needs the Provider's input,
    7. the Provider holds no Session Content after the Session beyond the period in Section 4, subsection 10; nothing remains to be deleted or returned at the end of the Agreement. The temporary retention by Microsoft described in the Privacy Policy, Section 4, ends within the period stated there,
    8. the Provider makes available to the User the information necessary to demonstrate compliance with this subsection (these Terms, the Privacy Policy and, on request, a description of the processing) and allows for and contributes to audits, including inspections, conducted by the User or an auditor mandated by the User, on at least 30 (thirty) days' notice and no more than once a year, at the User's cost, and in the form of a review of documentation; these limits do not apply, the notice may be shorter and the audit may include an on-site or remote inspection, where an audit is required by a supervisory authority or by law, after a personal data breach affecting the User's Session Content, or where the documentation does not allow the User to verify compliance with this subsection; in those cases the User chooses the form of the audit, taking into account the Provider's confidentiality obligations towards other Users,
    9. Session Content is processed in the European Union; any transfer outside the EEA takes place only under the safeguards described in the Privacy Policy, Section 6,
    10. the User is responsible for having a lawful basis for processing the personal data of the other participants, for informing them where required and for the lawfulness of their instructions.

Section 15. Changes to the Service

  1. The Provider may make changes to the Service in the event of:
    1. the need to adapt the Service to new devices, operating systems or software used by Users to access the Service,
    2. a decision by the Provider to improve the Service by adding new features or modifying existing features, including changing the AI models or suppliers used, provided that the principles described in Section 10 and in the Privacy Policy are maintained,
    3. a legal obligation to make changes, including the obligation to adapt the Service to current legal requirements.
  2. Changes to the Service may not involve any costs on the part of the User.
  3. The Provider informs the User of changes to the Service by a notice in the Application (account pages or App). Additionally, information about changes may be sent to Users by email.
  4. If a change to the Service will materially and adversely affect the User's access to or use of the Service, the Provider informs the User of:
    1. the nature and date of the change, and
    2. the User's right to terminate the Agreement with immediate effect within 30 (thirty) days of the change or of the notice, whichever is later.
  5. The information referred to in subsection 4 is sent to the User by email no later than 7 (seven) days before the change.
  6. Termination of the Agreement by the User pursuant to subsection 4, item 2 is effected by submitting a termination declaration to the Provider or by deleting the Account. The declaration may be sent by email to the address specified in Section 1, subsection 5, item 1.
  7. Termination of the Agreement pursuant to subsection 4, item 2 has the same effects as those provided for in Section 7 in the event of withdrawal from the Agreement due to a Non-Conformity.
  8. The Provider may discontinue the Service, in whole, for example at the end of the launch period or on ceasing its business activity, with at least 30 (thirty) days' notice sent to the Account email address and published on the account pages and the uhint.me website. On the discontinuation date the Agreements end and the Provider deletes the Accounts. The price paid for unused purchased Session Time is refunded under Section 8, subsection 6. Session Time granted free of charge expires on that date and has no monetary value.

Section 16. Changes to the Terms

  1. The Provider may make changes to these Terms only in the event of:
    1. a change in the Provider's scope of business,
    2. the Provider commencing the delivery of new services, modifying existing services or discontinuing their delivery, including the introduction of paid top-ups of Session Time and the end of the launch offer,
    3. a technical modification of the Application requiring corresponding amendments to the Terms,
    4. a legal obligation to make changes, including the obligation to adapt the Terms to current legal requirements, or a decision of a court or authority requiring a change.
  2. The User is informed of changes to the Terms at least 14 (fourteen) days before they take effect: by publication of the amended version on the uhint.me website, by a notice on the account pages, and by a notice sent to the Account email address which contains the date on which the amended Terms take effect, the full text of the amended Terms (in the body of the email or as an attachment) and a link to them. Each version of the Terms carries a version date, and previous versions remain available on the uhint.me website.
  3. The Provider sends only emails necessary to operate the Account and the Agreement: one-time codes, confirmations that Session Time has been added to the Account (Section 5), notices concerning the Account (such as a blocking, termination, deletion, or acknowledgement of a withdrawal or complaint), replies to the User's messages, and notices of changes to these Terms or the Privacy Policy. The Provider does not send newsletters or marketing emails.
  4. Agreements concluded before a change to the Terms are governed by the Terms in effect at the time of their conclusion, subject to subsection 5.
  5. A User who does not agree to a change to the Terms may terminate the Agreement with immediate effect at any time before the amended Terms take effect, and in any case within 30 (thirty) days of receiving the notice of the change, by deleting the Account or by a declaration sent to the address specified in Section 1, subsection 5, item 1. The User is not bound by the amended Terms before they take effect. If the User continues to use the Application after the amended Terms take effect and has not terminated the Agreement, the User is deemed to have accepted the changes. The User is clearly informed of this consequence in the change notification.
  6. Upon receipt of the declaration referred to in subsection 5, the Provider promptly deletes the Account.

Section 17. Governing Law and Dispute Resolution

  1. The current version of these Terms is effective as of October 23, 2026.
  2. These Terms and the Agreement are governed by the law of the Republic of Poland, regardless of the User's country.
  3. The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of the Consumer's habitual residence; where those provisions are more favourable to the Consumer, they apply.
  4. Disputes shall first be resolved through amicable negotiations. In the absence of agreement:
    1. disputes with Consumers and with Entrepreneurs with Consumer rights are resolved by the court having jurisdiction under the applicable provisions; a Consumer may also bring proceedings before the courts of the country of their habitual residence where the law of that country so provides,
    2. disputes with other Entrepreneurs are resolved by the court having jurisdiction over the Provider's registered office.
  5. With respect to Users who are residents of the United States of America, Section 11, subsections 8–12 apply to the extent permitted by the law of the User's state of residence, and disputes are resolved on an individual basis in accordance with Section 11, subsection 11. The choice of Polish law does not deprive such a User of rights under the mandatory provisions of that law.
  6. Matters not regulated by these Terms are governed by the applicable law specified in subsections 2–3 above.
  7. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision is replaced by a valid provision that reflects the parties' intent to the maximum extent possible (severability).
